Marriage In the Philippines

Here is what you need if you want to get married in the Philippines. This will happen only if you accomplish this:
  • You will have to go to the American Embassy in Manila and obtain an Affidavit in Lieu of a Certificate of Legal Capacity to Marry.
*This Affidavit is required by the Philippine government to obtain a marriage license.The service fee for this is $30 dollars.

Now, you may ask this question: What other paper work will I need?
You need the following:
  1. Passport
  2. Divorce papers if applicable.
  3. Parents consent if you are 18-21 years of age.

Types Of Power Of Attorney

General Power Of Attorney:

Any power of attorney should be given only to a trusted person. This person granted the power of attorney is called the attorney in fact. The attorney in fact has the power to do anything the document grants. The general power of attorney should be limited to necessary facts.


Specific Power Of Attorney:

This allows the attorney in fact to be limited to a specific act. For example, you want to sell a car and will not be in the country. You can have a trusted person to sell the car for you. They will only be able to do that specific act of selling the car for you.

Health Care Power Of Attorney:

This will allow someone usually a family member. To make health care decisions for you. When you enter a hospital you never know if you will be able to make decisions throughout your treatment. In most states you can sign a Health Care Power Of Attorney. Your hospital has its own form for this so you should use that one.

The Power Of Attorney

The Power Of Attorney gives a designate person the right to take legal action in your name. For example, you might want to sell your house and are out of the country. You could give someone a power of attorney to sign the deed for you. Four Different Forms Of Wills

I will list four types of wills for simple situations:

1. Spouse with Minor Children- This is the form you would use if you want your property to go to your wife. If your wife would die before you, the property would go to your children. You may appoint one person to be the Guardian over the children and their estates.

2.Spouse and no Children- Use this form if you want your property to go to your wife. If your wife dies before you, property will go to others or the descendants of others.

3. No Spouse-Minor Children- Use this form if you do not have a wife. Your property will go to your minor children. You may also appoint a Guardian over the children and there estates.

4. No Spouse-No Children- You will use this form if you do not have a wife or children. Your property will go to the survivor of the people you name in the will.

The Will

Let us start by asking what is a Will? A will is a document that:

1.States who will get your property.

2.Who would be guardian of your children.

3.Who will manage your estate upon your death.

If you do not have a will,then it will be decided by the laws of your state who will get your property. In most cases, it will go to your behalf and children. Fidel Castro Who Cares

Fidel Castro made some comments on Tuesday about how the right was against Obama because he was black. My question is this: why would anyone in the U.S. care what Castro has to say? He has the nerve to make comments about any country when in His own, there are countless numbers of people being held in His prison cell! One thing you can say about Castro is that, He is not prejudice. If you do not agree with His policy it does not matter if you are black or white, you will end up in one of His prisons. You may disappear and never be heared from again! The only news the American people want to hear out of Cuba is that, he in the ground and never to be heard from again.

No Cola

Just a short note on cost of living allowance(cola) for the seniors on Social Security. For the first time in a Generation, there will be NO raise for people on Social Security. A lot of older folks count on that raise. Normally, there is one for every two years. I hope the Congress will look into this matter and take action.

Blogger's Identity Revealed

Google was forced to reveal the identity of Blogger Rosemary Port by the court. Ms. Port had called model Liskula Cohen a skank and ho. She did this anonymously on her blog. Port wants to sue Google for $15 MILLION DOLLARS because her name was revealed. In my opinion, she can't win because google revealed it after the court requested it. Before you can sign up in Google, you have to agree on the terms and services that they have. So, for all bloggers out there who wanted to attack people, say it out loud and DO NOT HIDE ANONYMOUSLY. If it is not the right thing to say, do not say it.

To Fly Or Not To Fly

The answer to the question may not be up to you. If you are on the no fly list you may be in for a long bus ride. Over 900,000 people are on the no fly list. The list is maintain by TSA which is part of Homeland Security. You can end up on the list if you are a known terrorist or a supporter of a terror group. If you pose a risk of piracy,or a threat to the safety of the traveling public.

There are two list you can end up on the no fly list or the select list. The select list is made up of political activists. On this list you will need to have additional screening before you board your flight.

How do I get off the list? Contact Homeland Security and they will inform you how to get your name off the list. Good luck with that.

The Interview

What To Expect:
Most of the time the person who will interview you will be an immigration officer.
What should I expect?
You will be ask to take an oath which is simple. You will say your promise to tell the truth. The officer will verify your identity so bring a picture ID passport, driver's license and state ID card.
One question that will be ask is why you are applying for asylum? So, go to your interview with the correct paper work and be prepared to answer questions about your situation and your country. Good luck.

Questions Part Two

Asylum

Can I apply if I am convicted of a crime? Yes, you can but it will depend on what kind of crime it was.

Who will determine if I will be granted asylum? Immigration officer or a judge of the immigration court.

How will it be determine if I am granted asylum? You will have to meet the definition of a Refugee.

How is a Refugee determine? This will be based on the information you provide on your application. Also the information you give at your interview or hearing.

The interview or hearing is very important so make sure you have your facts correct and in order. The interview will last at least an hour or more and will be very intense so be prepared.

Case Status Inquiries

To make inquiries to USCIS about the status of your case you may call 1-800-375-5283. You will need the following:

1. Receipt number

2. Alien Registration number

3. Type of Application Filed

You may email your Service Center if 30 days have passed and you have not been contacted with an answer about your status.

If there was no response from your Service Center within 21 days, you should email USCIS Headquarters Office Of Service Center Operations. Email address is scopsscata@dhs.gov .There should be a response within ten days.

Adjustment of Status Interview

When you apply for Adjustment of Status usually, you will be given another interview to prove to them that the documents you submitted are all true and correct. There is no need to have inhibitions because you have been to all the series of interview already. This time, it is more easier for you to handle.

To help you more, these questions are easy to answer. Based on the applicant's experience.

  • Name and Date of Birth of Spouse.
  • When and where did you meet your spouse?
  • Describe this 1st meeting.
  • Did you make arrangements to meet again?
  • Did you exchange phone numbers?
  • When did you meet next?
  • Where were you living at the time?
  • Where was your spouse living?
  • When did you decide to get married?
  • Where were you at the time?
  • Did you live together before marriage?
  • When and where did you get married?
  • How did you and your spouse get to the church, courthouse, etc.?
  • Did you exchange wedding rings?
  • Where had you purchased these rings?
  • Did you and your spouse purchase them together?
  • Where was it held?
  • Do you have any photos of the ceremony and /or reception?
  • Describe the reception.
  • Did any of your, and your spouse’s, family members attend? If so, who?
  • Did you go on a honeymoon?
  • If so, when and where?
  • If you did not have a reception, what did you do after the wedding ceremony?

AOS: Vaccination Supplement

When you arrived in the US as K1 Visa, you have to follow what the DS-3025 required you to do and everything will be alright. After the marriage, you should process your adjustment of status as soon as possible. Please apply within one year of the original medical, you need an I-693A. This is USCIS'S VACCINATION SUPPLEMENT.

In most cases though, as long as you follow your DS3025 requirements, your I-693A is easy. But, there are immigration doctors who required you to take all the necessary vaccinations in the 1-693A and doesn't even recognized the DS-3025.

My wife insisted that all she need is the 3 shots needed which was not taken in the Philippines. Some of them just need your money. As long as you know the rules and you follow it carefully, they cannot forced you to take them.

It is up to the immigration whether they accept your papers or not. If you want to be absolutely safe in terms of your medical documentation as a K-1 adjusting status, you should take your DS-3025 to a USCIS-certified civil surgeon and ask them to transfer the information from your DS-3025 to an I-693A.

They should do this for a nominal charge. If they try to convice you to take a full medical examination, DO NOT LISTEN. You ONLY need the vaccination supplement. Read the memo from the USCIS documents that this completed form will remain valid beyond one year when submitted with most Adjustment of Status applications.

Visa Waiver Program

What is the VWP program offered by the U.S. State Dept? This is a program that permits nationals of 35 approved countries to travel to the U.S. without having to obtain a visa. You must be coming to the U.S. as a tourist and your stay must be 90 days or less. Most of the countries in Europe fall under these requirements. If you go to the State Dept. web site there is a complete list of approved countries.

Form Of The Cover Letter

When you process an Immigration paper, make sure that you read carefully the instructions given. Pass the correct form and insert the pertinent papers that is needed. Lacking proofs would mean a change of recieving an RFE. Therefore, submission of added papers as proof would make the processing longer. When you submit your documents read the instructions carefully.

Such as:

The Cover Letter
  • needs to be clear and concise

Your address
  • needs to be the correct one and your present residence

Address of Homeland Security and Address of Service center

  • the address of which your papers are assigned into. Look carefully what address should you use for specific papers. The address matters where your location is under too.


Fill up the Immigration Forms that you intend to pass.

Make sure that all supporting documents is inserted too.

Adds

Just a short note on some of these immigration adds that we see online. For example, "short wait guaranteed approval." I don't know how they can advertise a short wait, they do not control that. You submit your paper to your Service Center and Immigration takes care of it from there. You will receive a letter from them if it is approve or if there is a problem. Another one is "Guaranteed Approval" and again this depends on Immigration. So buyer beware! Have a nice life.

Ouestions To Ask At Town Hall Meeting.

Here are few questions you might ask at your Town Hall Meeting:

  • Will I lose my plan and doctor under the Obama plan?
  • Will members of Congress have the same plan as we do? If not why?
  • How will this plan affect our budget?
  • Will we have a high deficit down the road?
  • On public plan, will care be ration?
  • Will abortions be funded under the Obama plan?
So, folks go to your meetings and if you don't like the answers, remember that 2010 is coming soon and you can make a real change then! Have a nice life!

Town Hall Meetings/ Heat Up

I watched several reports on the town hall meetings lately and its very alarming. It is like, they get quit heated or what? Congressman are going to get an ear full when they show up. Sen.Specter brought Sebelius with him. She is in-charge of health in the cabinet. They were confronted by many questions that could not be answered. Specter tried to use the excuse that the bill was to long to read. He was then screamed at even louder. Can you believe that we pay this clown over a $100,000 dollars a year to do his job. But, he does not have the time to read the bill. Don't worry Senator Specter, I think you will have plenty of time after the election in 2010. As for Sebelius, she just stood there and tried to make the same old excuses. She also was shouted down as well. Another thing, I have noticed on the different news channels are pro-Obama such as MSNBC. When they report, they call the folks at the meeting "the mob". If people asks questions and demand answers, they are mobs. So, if your Congressman does get up the nerve to have a town hall meeting, please attend and confront him with your questions. If he does not have any meetings, remember that 2010 is just around the corner. Have a great life.

Clown Of The Day!!!

The first Clown of our new series is our old friend Hugo Chaves! Why do we classify Hugo as a Clown? One good reason is that, he has vowed to bring down our way of life. Another thing was, he is in the process of closing 34 radio stations in Venezuela. They do not agree with his views. One way to defeat this Clown though: boycotting Citgo gas stations here in the U.S. We can hit him where it hurts in the pocket book! So come on my friends, let us bring this Clown down!

Bad Behavior!!!

Nobody likes to see bad behavior in kids but when you see this in a grown person it is even worse. You can witness this behavior in airports, car rental counters, and hotels. If these people knew how silly they look and most people were looking at them with contempt. When you are having a problem, use your brain and do not try to solve it in a clam matter. You will get better results rather than start cussing. Some of these idiots start using the F- word thinking they will intimidate the other person. Most people will not help you when you start this behavior. Remember, you will get more with sugar than salt. Have a great life!

Charlie(tax dodge) Rangel

Charlie (the tax dodger) Rangel is a piece of trash that we have in the government. All he did is take... take.... take... for his own gain. He is the Chairman of the ways and Means Committee, really? What a joke! He has many excuses. He does not understand Spanish and here is really a good one. His wife overlooked it and his staff did not complete the disclosure form, wow! Charlie,
do you think anybody believes you? I remembered that he had an issue cheating on $73000 dollars income on the rental in Dominican Republic. By the way, he blamed it to them also. The tax dodger was on Fox this morning and I noticed he had two big rings on his fingers. I wonder if they were bought with our tax money! Just wondering here. Please people wake up and vote all of the crooks out of office!!

Al Franken -Pompous Ass

Just a short note on Al Franken. He had a confrontation with T. Boone Pickens. Its not a very smart move on his part though.He is still mad about Mr.Pickens backing of the swift boaters. Well, Franken has the backing of George Soros and also the backing of (move on .org). So why is he mad now? He has no room to be on this group. He is far worse than Mr Pickens. Grow up Franken because you represent the U.S. Senate now.

The Interview

Now, we come to the interview that if you have done your homework good,everything will be good. Your papers should be in the proper order. The preparation will not be as difficult as you think. Here are some questions they may ask your Fiancee.

How long have you known your Fiancee?

When did you meet?

When is your Fiancee's birthday?

Where does the family live?

What is the date of your marriage?

What does your Fiancee do for a living?

How long have you been engaged?

These are just some of the questions that will be in the interview. You should not be nervous because the questions they will ask you is all about your relationship or family. Just relax and on your interview, be prepared. Good luck!
