If you are at a garage sale and saw a painting which you recognized as a Picasso then, you buy it for $50; is it fraud to fail to disclose this information to the seller?
The answer is NO. It is not fraud . The law of contracts does not require either party to disclose everything they know about the subject matter of the contract except in limited circumstances.
