Consequences of Over Staying your Visa.

Do you know the consequences if you overstay your visa in the USA? In years past overstaying your visa was relatively overlooked. That is not the case today. Prior to 1996 a person would not face harsh consequences for overstaying their visa. They could be deported and were considered to be without legal status in the USA. In many cases they would leave the United States and reenter at a later time.

In 1996 under the new immigration policy the laws were dramatically changed and overstays were punished more harshly. And overstayed Visa is a person who stayed stay beyond the time authorized when they entered the country or any extensions they received. Some of the consequences of overstaying your visa are:

You may be barred from entering the United States from 3 to 10 years.

Three years for over stating your visa by six months. 10 years if you overstay your visa for a year. If you have overstayed your visa you will also not be allowed to obtain a visa in different countries you must return to the country of your nationality.

The simple way to avoid this problem is to apply for a extension of your visa before it expires. If you file for the extension you will be considered maintaining status and be allowed to stay while they are considering your request even if it passes the expiring date on your I-94 form.

The Interview

What To Expect:

Most of the time the person who will interview you will be an immigration officer.

What should I expect?

You will be ask to take an oath which is simple. You will say your promise to tell the truth. The officer will verify your identity so bring a picture ID passport, driver's license and state ID card.

One question that will be ask is why you are applying for asylum? So, go to your interview with the correct paper work and be prepared to answer questions about your situation and your country. Good luck.

AOS: Vaccination Supplement

When you arrived in the US as K1 Visa, you have to follow what the DS-3025 required you to do and everything will be alright. After the marriage, you should process your adjustment of status as soon as possible. Please apply within one year of the original medical, you need an I-693A. This is USCIS'S VACCINATION SUPPLEMENT.

In most cases though, as long as you follow your DS3025 requirements, your I-693A is easy. But, there are immigration doctors who required you to take all the necessary vaccinations in the 1-693A and doesn't even recognized the DS-3025.

My wife insisted that all she need is the 3 shots needed which was not taken in the Philippines. Some of them just need your money. As long as you know the rules and you follow it carefully, they cannot forced you to take them.

It is up to the immigration whether they accept your papers or not. If you want to be absolutely safe in terms of your medical documentation as a K-1 adjusting status, you should take your DS-3025 to a USCIS-certified civil surgeon and ask them to transfer the information from your DS-3025 to an I-693A.

They should do this for a nominal charge. If they try to convice you to take a full medical examination, DO NOT LISTEN. You ONLY need the vaccination supplement. Read the memo from the USCIS documents that this completed form will remain valid beyond one year when submitted with most Adjustment of Status applications.

Visa Waiver Program

What is the VWP program offered by the U.S. State Dept? This is a program that permits nationals of 35 approved countries to travel to the U.S. without having to obtain a visa. You must be coming to the U.S. as a tourist and your stay must be 90 days or less. Most of the countries in Europe fall under these requirements. If you go to the State Dept. web site there is a complete list of approved countries.

Form Of The Cover Letter

When you process an Immigration paper, make sure that you read carefully the instructions given. Pass the correct form and insert the pertinent papers that is needed. Lacking proofs would mean a change of recieving an RFE. Therefore, submission of added papers as proof would make the processing longer. When you submit your documents read the instructions carefully.

Such as:

The Cover Letter

• needs to be clear and concise

Your address

• needs to be the correct one and your present residence

Address of Homeland Security and Address of Service center

• the address of which your papers are assigned into. Look carefully what address should you use for specific papers. The address matters where your location is under too.

Fill up the Immigration Forms that you intend to pass.

Make sure that all supporting documents is inserted too.

The Interview

Now, we come to the interview that if you have done your homework good,everything will be good. Your papers should be in the proper order. The preparation will not be as difficult as you think. Here are some questions they may ask your Fiancee.

How long have you known your Fiancee?

When did you meet?

When is your Fiancee's birthday?

Where does the family live?

What is the date of your marriage?

What does your Fiancee do for a living?

How long have you been engaged?

These are just some of the questions that will be in the interview. You should not be nervous because the questions they will ask you is all about your relationship or family. Just relax and on your interview, be prepared. Good luck!

Step Five

If you decided to go with the K-1 visa, that is really good. The K-1 has just about a 98% success rate especially for women.What are the legal requirements for this visa?

1. The person who files the petition must be a U.S. citzen.

2. Both must be legally able to marry each other.

3. Must have met in the past two years.

4. Show proof of relationship such as photos of trip.

5. Must have passport and birth certificate

Step Four

Now, we go on to step four on K-3 visa vs K-1 which one do you choose to bring your loved one to the U.S? Should you marry in the country of your sweetheart or wait and bring them over on a Fiance(e) visa? From my experience, I would go with the K-1 because it is less complicated. If you marry in another country like I said in my previous steps, this will require more paper work. I also found a k-1 visa does go faster than the K-3. How long does it take? Well this is depending on the circumstances of your case. If you have completed the information correctly such as the correct address and phone number, there may have to be a security check done all of these things and it will slow down the process if the information is not filled out correctly.

Step Three

So now, you are in the country of your sweetheart and having a great time and the idea comes into your head says... why not get married here, right? In most cases, this is not a good idea. Why you ask? Well most of the time, it is not easy to marry in a foreign country as you will need a lot of paper work which will take some time to gather. If you do this, you will have to bring your partner to the U.S. on a K-3 visa. On the other hand, if you file a Fiancee visa or K-1, this will be much faster. So, it is up to you K-3 vs K-1, its your pick. Tomorrow we will discuss both visas to help you make the right choice.

Step Two

Before you can proceed with any paper work there is a regulation that states the two people must have met in person within the past two years. So you probably will have to go to the country where your sweetheart is living. Remember to save all your receipts such as airplane tickets and hotel bills as proof you did visit your future wife or husband. Make sure your passport is stamped on entry into the country.Make sure you take many pictures on your trip as this is very important to your case. If you are traveling to the Philippines You should have your partner meet you in Manila at the airport it will make things much simpler. So you have met the girl or man of your dreams on line the only problem is they live in another country. Your relationship has gone so well that you want to marry and bring your sweetheart to the U.S.. In the next few days we will walk you threw this process. K-3 Visa Versus Fiance Visa

Fiance Visa K-1 Visa
