Medical Power of Attorney

What is a medical power of attorney? This is a power of attorney that is signed by a competent adult that puts medical decisions in the hands of a trusted person that will make health decisions on your behalf and in your best interest.

When does the medical power of attorney go into effect and when is it terminated? This power of attorney goes into effect immediately when you sign it. It will stay in effect indefinitely unless the person signing it terminates the power of attorney or it has a date of termination.

The person designated to act on your behalf on the medical power of attorney is known as the agent. The agent can make decisions on your health if your doctor determines you are incompetent to make any decisions . This must be done by a written statement from the doctor . This must be filed in the patients medical records. Decisions on health care may not be a if the principal objects , whether incompetent or not.

In this type of document the principal may limit the agent's decision making authority. It would be in your best interest to consult an attorney to prepare this document.
